Waiver and Release of Liability

I (hereinafter referred to as “client”) acknowledge that the activity I am to undertake is physically challenging and that by participating in it I am exposed to certain risks and I do so voluntarily. I agree to hold Tone You Up, Inc. and its fitness instructors harmless and will not sue, in the event of any action(s) or claim(s) made by client(s) (and/or other parties) results in injury, loss, damage or death.
We recommend that all participants consult a physician prior to engaging in any physical or strenuous activities.

Waiver of Image and Likeness

As a client of Tone You Up, Inc., I hereby irrevocably grant this company and any parties contracted by Tone You Up, Inc. the full rights to use, for promotional and all other legal purposes, any photographs, videos, recordings and any other record of myself created by my participation in any programs and services of Tone You Up, Inc.

Termination of Contract
I hereby agree that Tone You Up, Inc. has the right to suspend or terminate my enrollment due to non-payment of dues or fees, or for behavior that interferes with the enjoyment of client(s) and/or of other participant(s), trainers or for any reason deemed sufficient with the sole discretion of Tone You Up, Inc. In addition to other rights, Tone You Up, Inc. reserves the right to; (A) collect and charge client(s) a service fee on all balances which are 30 days past due; (B) recover from client(s) the applicable collection fees, court cost(s), and reasonable attorney’s fees; (C) and finally collect from client(s) a service fee for any check or draft payable to Tone You Up, Inc. which is not honored.

Prior to signing this document, I have read and understood all conditions, responsibilities and risks and know that it affects my legal rights. Also, I have completed the above-listed screening questions to the best of my knowledge and ability.
